1. About this site
This site (graphixcon.com) is operated by an individual proprietor based in Burhanpur, Madhya Pradesh, India, trading as Graphixcon. Anywhere this document says “we”, “us” or “our”, that’s what’s meant. Anywhere it says “you” or “your”, it means the person browsing the site, contacting us, or otherwise interacting with the content here.
The site exists to describe the work we do, the projects we have shipped, and to let prospective clients reach us. It is not a marketplace, does not host user accounts, does not sell downloadable products, and does not run advertising or third-party trackers. If any of that changes, this page is where it would be reflected first.
2. Acceptance of these terms
By opening this site, reading a page, or sending us a message through the contact forms or the booking link, you confirm that you have read these terms and that you accept them as they apply to your use of the site.
If you do not accept any of the terms below, the simplest course is to close the site and not contact us through it. You can still reach us through other means if you would like to.
3. What we may change
We may update the copy on this site, the case studies we publish, the services we list, the contact processes, and the legal documents at any time without prior notice. Modifications are effective the moment a refreshed page is published.
Substantive changes to these Terms, the Privacy Policy, or any other legal document will be reflected by an updated “Last updated” date at the top of the affected document. If a change is material and relates to how we handle your data, we will also make a reasonable effort to contact anyone who has booked a call or sent us a message in the prior twelve months.
4. Permitted use
The site and everything on it (text, images, source code, case-study descriptions, layout, the logo) belongs to us or to our licensors. You are welcome to read it, share links to it, quote brief excerpts in good faith (with attribution and a link back), and use the contact mechanisms to talk to us. You may not republish it in full, scrape it to build a competing service, present our case studies as your own work, or misrepresent any relationship with us.
5. Prohibited use
You agree not to use the site or its contact forms to send us content or messages that:
- are unlawful, harassing, defamatory, discriminatory, obscene, or otherwise inappropriate;
- misrepresent your identity or claim to act on behalf of someone you do not represent;
- contain software viruses, exploits, or anything else designed to interfere with the site or any system that hosts it;
- constitute unsolicited promotion, spam, or chain communications;
- attempt to reverse-engineer, scrape at scale, or probe the site beyond what a normal browsing session would do;
- violate the intellectual property or contractual rights of any third party.
We may take technical steps to filter obvious abuse and we may decline or ignore messages that fall into any of the above.
6. No accounts, no logins
We do not offer user accounts. There is nothing to register for, no password to forget, no profile to delete. If you submit a contact form, we keep what you sent us under the terms described in the Privacy Policy. If you book a call through Cal.com, Cal.com’s own platform handles the scheduling and the data associated with that booking lives with them under their own policies.
7. Professional work, no public offer
Anything on the site that describes our work — case studies, listed services, stack chips, domain areas, named engagement shapes — is illustrative. It is not a public offer, a tender, a price list, or a guarantee of capacity. The moment you share something with us under NDA, that is the first time we are in any conversation about specific work.
Likewise, anything you submit through the contact forms is not a binding instruction. Until we have signed a written agreement, none of us is on the hook for anything.
8. External links
The site links to a small number of third-party services — primarily Cal.com for booking, GitHub for our public repositories, and our social profiles. We do not control those services, and we are not responsible for their availability, content, or privacy practices. If you click one of those links, the relevant operator’s terms and policies will apply once you land there.
9. No warranty on the site itself
The site is provided “as is”. We do our best to keep it accurate, available, and secure, but we do not warrant that:
- the site will be uninterrupted or error-free;
- the information on it will always reflect our current thinking, capacity or pricing;
- defects will be corrected within a particular timeframe;
- the site is free of viruses or other harmful components.
10. Limitation of liability
To the extent permitted by law, our aggregate liability to you for any claim arising out of or related to your use of this site (excluding any liability for fraud, death, or personal injury where it cannot be limited) is capped at the lesser of (a) the total fees you have actually paid us in the prior twelve months for professional services, or (b) INR 10,000.
We are not liable for indirect, incidental, special, or consequential losses, including lost profits, lost data, or business interruption, that arise out of or in connection with your use of the site.
11. Indemnity
If your use of the site in violation of these terms causes us a loss, claim, or expense, you agree to cover that loss to the extent it was reasonably foreseeable. This does not apply where the loss was caused by our own negligence or wilful misconduct.
12. Intellectual property
The branding, layout, written case studies, the source code of this site, the logo, and any other original content here are owned by us or by our licensors. You may quote from case studies in good faith with attribution and a link back. All other rights are reserved.
If you believe that material on the site infringes your intellectual property rights, please email us at the address on the Contact section of the site and we will review and respond promptly.
13. Booking and discovery calls
Discovery calls scheduled via the “Let’s talk” button route through Cal.com under our Graphixcon account. By booking, you agree to Cal.com’s own terms and privacy policy in addition to ours. We use Cal.com for the scheduling mechanics; the substantive conversation and any work that follows is governed by a separate written agreement.
14. Governing law
These terms are governed by the laws of the Republic of India. The primary forum for any dispute is the competent court in Burhanpur, Madhya Pradesh, India, save where a mandatory consumer-protection statute of your home jurisdiction gives you broader rights, in which case that statute prevails.
15. Severability
If any provision of these terms is held unenforceable, the remaining provisions continue in full force and effect. The unenforceable provision will be replaced by an enforceable provision that most closely reflects our original intent.
16. Contact
Questions about these terms should go to the email address listed on the Contact section of this site. We read what comes in and respond within one business day during working hours (Asia/Kolkata).
